General Terms and Conditions of wishproject (AGB`S)

  1. scope
    For the business relationship between the buyer and the seller, the following general terms and conditions apply exclusively in the version valid at the time of the order. Deviating agreements must be made in writing to be valid.

  2. Conclusion of contract
    By clicking the order button, the buyer undertakes to make a binding commitment to the provider to wish to purchase the contents of the shopping cart. The contract is concluded through confirmation by the provider in text form (e.g. email or letter) from the provider.

  3. Manufacturing time
    1. After receipt of payment, all items are made within 10 working days (except on Saturdays, Sundays and public holidays in Thuringia) to the size specified by the customer or made to measure. Usually the production goes faster (approx. 4-6 working days), then we send the articles directly, provided that we have received payment.
    2. If we are in default ourselves, the buyer must give us an additional first of 18 days. After this grace period has expired, he can withdraw from the contract if the goods have not been reported to him as ready for dispatch by this time.

  4. prices and shipment
    1. All prices include the statutory VAT of 19%
    2. The dispatch takes place via the German Post. If the customer has entered an email address, he will receive a dispatch email.
    3. Shipments outside Germany are only sent as insured registered mail or as a DHL package.

  5. Payment and payment deadline
    1. Payments in advance (bank transfer), PayPal and direct transfer are accepted.
    2. When paying in advance, we ask for a payment within 7 days, with PayPal and direct transfer, the payment must be received within 3 days.

  6. Transport damage
    1. Please make sure to receive an undamaged package from the post office. If necessary, open in the presence of the parcel carrier. Do not accept any torn or obviously opened consignments, as this will tacitly confirm receipt of the delivery in perfect condition to the post office. If in doubt, write down the messenger's name.

  7. Defects and warranty
      1. The buyer must submit complaints to us in writing within 10 days of receipt of the goods at the destination. Complaints are only taken into account if the goods are still in the condition in which they were delivered.

      2. Every order comes with care instructions - we generally recommend hand washing! The limitation period for statutory warranty is 2 years. If the clothing is handled improperly or if the manufacturer's instructions regarding care and washing instructions are not followed, the warranty is void. In the event of defects through our fault, we will take back goods that have been recognized as defective and deliver faultless goods in their place. If this is not possible, we will refund the purchase amount.
  8. Size information
    1. The specified sizes in centimeters are generally approximate and not binding. Depending on the cut, this information can vary slightly, minor deviations are production-related and do not represent a defect. The size information in the respective offer is always valid. If you have any questions about size information, you can contact us at any time!

  9. Item properties
    1. The item descriptions in the offer texts try to give an idea of ​​the nature and quality of the goods offered. If you are unclear about the properties / sizes of an article, we recommend that you send us an email. Errors are expressly reserved.
    2. Color deviations between the images on the Internet and the articles are due to technical reasons and do not represent an error.

  10. Retention of title
    1. The goods remain the property of wishproject until they have been paid for in full.

  11. Bearing the costs for the return within the framework of the right of withdrawal
    1. When exercising the right of cancellation to which he is entitled according to the cancellation policy, the customer has to bear the regular costs of the return if the goods delivered correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of EUR 40.00 or if the price is higher the item has not yet provided the consideration or a contractually agreed partial payment at the time of revocation. Otherwise, the return for the customer is free of charge.

  12. data protection
    1. The data collected in the course of the ordering process are used solely for processing in the context of normal customer service and are subject to the applicable data protection regulations.

  13. Place of performance, place of jurisdiction
    1. The place of performance for both parties to the contract is Gotha. The place of jurisdiction - also in the bill of exchange and check process - is Gotha if our contractual partner is a merchant.

  14. Severability clause
    1. Should one of the above provisions be or become ineffective, this shall not affect the validity of the remaining provisions. The ineffective provision should be replaced by an effective provision that comes closest to the meaning and economic purpose of the ineffective provision. With the publication of these terms and conditions, all previous business and delivery conditions lose their validity.
