Terms and conditions

  1. Scope For the business relationship between the buyer and the seller, only the following General Terms and Conditions shall apply in their version valid at the time the order is placed. Deviating agreements need to be valid in writing.
  2. Conclusion of the contract By clicking on the order button, the buyer undertakes to make a binding commitment to the provider to acquire the contents of the shopping basket. The contract is concluded by confirmation of the provider in text form (e.g. e-mail or letter) of the provider.
  3. Manufacturing Time
    1. All items will be made after receipt of payment within 10 working days (except for Sams, Sundays and public holidays in Thuringia) to the desired size specified by the customer. shall be made to measure.     2. If we are in default, the buyer will have to set us a deadline extension of 18 days. After the expiry of this grace period, he/she may withdraw from the agreement if the goods have not been reported to him as ready for dispatch by this time.
  4. Prices and shipping
    1. All prices are inclusive of the statutory VAT of 19%
    2. The dispatch takes place via the German postal service. If the customer has deposited an email address, he will receive a dispatch confirmation mail.
    3. Consignments outside of Germany will be exclusively sent as insured letter or as a DHL package.
  5. Payment and payment period
    1. Payments are accepted by advance payment (bank transfer), by Paypal and by immediate transfer.
    2. In case of payment via advance payment we ask for a payment within 7 days, with PayPal and immediate transfer the payment must have been received within 3 days.
  6. Transport damage
    1. Please make sure to receive an undamaged package from the post office. If necessary, open in the presence of the delivery staff. Do not accept an damaged or obviously opened parcel, since you are automatically confirming the receipt of the delivery in perfect condition. In the case of doubt, note the name of the delivery staff.
  7. Defects and Warranty
    1. Defects shall be made by the buyer in writing within 10 days of receipt of the goods at the place of destination. Complaints shall only be taken into account if the goods are still in the condition of delivery.
    2. Each order is provided with care instructions-we recommend hand washing in general!
      3. The limitation period for statutory warranty is 2 years. If the clothing is handled improperly, or if the manufacturer's instructions regarding care and washing instructions are not given, the warranty will be forgiven. In the event of defects by our guilt, we shall take back items that are from us confirmed as defective goods and replace them with flawless goods in their stead. Should this not be possible, we will refund the purchase amount.
  8. Sizes
    1. Specified dimensions in centimetres are approximate data and are not binding. Depending on the section, this information may vary slightly, slight deviations are due to production, and do not constitute a defect. Valid is always the size statement in the respective offer.   9. Item Properties
    1. The article descriptions of the offer texts try to convey an idea of the properties and quality of the goods on offer. In case of ambiguity about the properties/sizes of an article, the request is recommended by email. Error is expressly reserved.
    2. Colour differences between the images on the Internet and the articles are technically conditioned and do not constitute an error.
  10. Retention of title
    1. The goods remain the property of Wishproject until full payment is made.
  11. Cost support for the return within the scope of the right of withdrawal
    1. In the exercise of the right of revocation, the customer shall bear the regular costs of the return in accordance with the revocation instruction, if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed a sum of 40.00 Euro or if at a higher price the goods have not yet provided the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise, the return shipment is free of charge for the customer.
  12. Data protection
    1. The data collected in the course of the ordering process are used solely for processing within the framework of ordinary customer service and are subject to the applicable data protection regulations.
  13. Place of performance, place of jurisdiction
    1. The place of performance for both parts of the contract is Gotha. The place of jurisdiction-also in the change and cheque process-is, if our contractual partner is a merchant, Gotha.
  14. Severability clause
    1. Should any of the above provisions be or become ineffective, the validity of the remaining provisions shall not be affected by this. The ineffective provision should be replaced by an effective provision which is closest to the meaning and economic purpose of the ineffectating provision. With the publication of these General Terms and Conditions, all previous business and delivery conditions will lose your validity.
